- The Association hereby grants the renter access to and use of the building for events including weddings, fundraisers, meetings, auctions, and other social events as approved by the Association. The Association makes no representations or warranties as to the building or the use thereof and the renter accepts building as is.
- The Renter shall pay to the Association a fee in the amount indicated below per event. An initial non-refundable down payment in the amount of $200 for all events except the kitchen/bathroom/small room only (full amount of $75 due when booking just that room) is due when reservations are made. This amount is applied to the total usage fee. The remaining balance of the usage fee shall be due when access to the building is granted. CANCELLATION of the event by the Renter will result in complete forfeiture of down payment.
- Renters must comply with all applicable laws, rules, and/or regulations, and all polices of the Association, in its use of the building.
- Upon entering the building, renter shall inspect the building for safety dangers and usability of the building for the intended purpose and shall immediately report to the Association any pre-existing damage to or danger in the building.
- Renter agrees to leave the building and outdoor area surrounding the building in as good order and condition as when received. Renter is responsible for removing all equipment tables, chairs, decorations, staples, nails, etc. Should the renter use a vendor, renter is responsible for making sure vendor has cleaned up, (including but not limited to removing all trash cups, bottles, and other debris) from the building and surrounding area. ALL TRASH, including bathroom and kitchen trashes must be placed in the dumpsters in the parking area near the building and then taken to the curb. Staples in walls used for decoration must be removed following the event. All tables and chairs must be picked up and replaced in storage room.
- Rental of the building includes the use of tables & chairs.
ALCOHOL
Renter may serve alcohol at its event only if done in accordance with all applicable federal, state, and local laws and regulations. Renter shall warrant that all servers of alcohol are of legal age, have necessary licenses and/or certificates required to do so. RENTER SHALL ASSUME ALL LIABILITY ASSOCIATED WITH SERVING ALCOHOL. Further, IN ALL CASES where alcohol is served, renter MUST hire Cheney Police Department (separate from the rental fee of building) as security for the event. SECURITY OFFICERS MUST BE PAID UPON ARRIVAL. Please contact Ken Winter @316-542-3173. CONSUMPTION OF ALCOHOLIC BEVERAGES BY MINORS IN THE BUILDING OR SURROUNDING OUTDOOR AREAS IS STRICTLY PROHIBITIED.
The Association shall not be responsible in any event for any violations of the law by the renter or its vendors or guests.
Renter shall release, hold harmless, defend and fully indemnify the Sedgwick County Fair Association along with any and all officers or representatives of the Sedgwick County Fair Association from all liability for any injury to renter or its guest resulting from any cause whatsoever, including known or unknown dangers, including but not limited to acts of nature, renters use of building and intentional or negligent acts of third parties, except intentional acts of the Association. Further, renter shall indemnify and defend the Association against any claim for loss, damages or injury made by renter’s guests. The Association, officers, & representatives of the Association assumes no liability for damages to or loss of any property brought to the building.
Should events beyond the reasonable control of the Association occur, including but not limited to acts of God, fire weather conditions or disaster government regulation, civil disturbance or any other condition making it inadvisable, illegal or impossible for the Association to meet its obligations hereunder, the Association may cancel this agreement without any liability upon notice to the renter. In such event, fees paid by renter shall be refunded.
CLEANING
Renter will be responsible for picking up all tables & chairs. Removing all belongings/decorations from the building and premises. Picking up all trash from the inside and outside of the building. Taking all the trash dumpsters to the curb. Can have an additional 5 bags per dumpster at the curb. The Renter will then pay a cleaning fee of $100 per event or $50 per event if Kitchen only.
MISC.
Fees for the building rental will begin on the day the key is given to the renter. All functions must end by 12:00 AM with renters, guests, & vendors cleared from building by 1:00 AM.
Vaping & Smoking is not allowed in the building.
